Privacy Policy

DirectiveHR ("we," "us," "our") is a Canadian-registered business operating MindsetLab at directivehr.com (the "Site"). This policy explains what personal information we collect, why we collect it, who we share it with, and your rights under Canadian privacy law. We comply with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, including Quebec's Law 25, Alberta's PIPA, and BC's PIPA. If something here is unclear, email us at the address at the bottom.

Our 10 PIPEDA principles in plain English

Canadian privacy law is built on ten principles. Here's how we apply each:

  • Accountability — Our Privacy Officer (contact below) is responsible for compliance
  • Identifying purposes — We tell you why we're collecting information at the time we collect it
  • Consent — We collect personal information only with your knowledge and consent
  • Limiting collection — We collect only what's necessary for the stated purposes
  • Limiting use, disclosure & retention — We use it only for the purpose collected and keep it only as long as needed
  • Accuracy — We keep your information as accurate and current as possible
  • Safeguards — We protect your information with appropriate security
  • Openness — Our policies are publicly available (this page)
  • Individual access — You can request a copy of the information we hold about you
  • Challenging compliance — You can challenge our practices and we'll respond

What we collect

We collect three categories of information:

  • Information you give us directly — your name, email address, mailing address, payment details when you buy something, and any responses you provide on quizzes, surveys, or contact forms.
  • Information collected automatically — your IP address, browser type, device type, pages visited, time spent, referring URL, and similar usage data through cookies and analytics tools (see our Cookie Policy below).
  • Information from third parties — if you sign in or interact with us through a service like Stripe, PayPal, or a Pinterest link, we may receive limited information from that service consistent with their own privacy policies.

Why we collect it

  • To deliver the products, courses, and resources you've purchased or requested
  • To send the emails you've subscribed to (and only those — we don't sell your email)
  • To improve the Site and understand which content actually helps
  • To process payments through Stripe and PayPal (we never store your full card number)
  • To comply with legal obligations and protect against fraud

Who we share it with

We share personal information only with service providers who help us run the business. These include:

  • Payment processors — Stripe and PayPal (handle your payment data under their own strict policies)
  • Email service provider — for sending newsletters and transactional emails
  • Course delivery platform — to host and deliver purchased course content
  • Analytics — to understand site traffic in aggregate (see Cookie Policy)
  • Legal authorities — only if required by Canadian law, court order, or to protect our rights or yours

Cross-border data transfer

Some of our service providers are located in the United States and other countries outside Canada. When we share your personal information with them, that data may be subject to the laws of those jurisdictions, including lawful access by foreign authorities. We use providers that meet recognised data protection standards, but Canadian law cannot guarantee the same protection once data leaves Canada. By using the Site, you consent to this transfer.

We do not sell your personal information. Not to advertisers, not to data brokers, not to anyone. If this ever changes, we'll update this policy and obtain your express consent before any sale.

How long we keep it

We keep your personal information only as long as needed for the purpose it was collected, plus any legally required retention period. Under Canadian income tax law, we are required to retain transaction records for at least six years from the end of the relevant tax year. If you ask us to delete your data, we will — except where retention is legally mandatory.

Your rights under Canadian law

Under PIPEDA and applicable provincial laws, you have the right to:

  • Access — Request a copy of the personal information we hold about you, including how it's used and to whom it's been disclosed
  • Correction — Ask us to correct inaccurate or incomplete information
  • Withdrawal of consent — Withdraw consent for the collection, use, or disclosure of your information at any time (some withdrawals may end our ability to provide services)
  • Deletion — Request deletion of your information, subject to legal retention requirements
  • Portability — Receive your data in a portable, machine-readable format (Quebec residents under Law 25, others by request)
  • Complaint — File a complaint with the Office of the Privacy Commissioner of Canada or your provincial privacy commissioner

Quebec residents (Law 25)

If you reside in Quebec, you have additional rights under the Act to modernize legislative provisions as regards the protection of personal information (Law 25), including specific consent and transparency rights, automated decision-making disclosure, and the right to request that we stop disseminating information that infringes your rights. We can communicate with you in French on request.

To exercise any of these rights, email our Privacy Officer at the address below. We respond within 30 days as required by PIPEDA.

Children's privacy

The Site and our products are intended for adults (18+). We do not knowingly collect personal information from anyone under the age of majority in their province (18 or 19 in Canada, depending on the province). In Quebec, parental consent is required for processing personal information of any child under 14. If you believe a minor has provided us with personal information, contact us and we will delete it promptly.

Security

We use industry-standard practices to protect your data — encrypted connections (HTTPS), secure payment processors (Stripe and PayPal handle all card details directly), access controls, and minimum-necessary data collection. No system is 100% secure, but we take this seriously.

Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top will reflect the most recent change. Material changes will be communicated by email to subscribers and posted prominently on the Site for at least 30 days.

Contact our Privacy Officer at privacy@directivehr.com. We respond within 30 days as required by PIPEDA. You may also file a complaint with the Office of the Privacy Commissioner of Canada or your provincial commissioner (Quebec, Alberta, BC).

Terms of Use

By using this Site or buying any product from MindsetLab, operated by DirectiveHR, a Canadian-registered business ("we," "us," "our"), you're agreeing to these Terms. Please read them carefully. If you don't agree, please don't use the Site or buy our products. These Terms are governed by Canadian law, as set out below.

Who we are

MindsetLab is a digital education brand operated by DirectiveHR, a small business focused on mindset courses, micro-courses, quizzes, and digital tools for women building businesses. We are not a licensed mental health provider, therapist, doctor, financial advisor, or attorney. Our products are educational only.

Eligibility

You must be the age of majority in your province or country of residence to purchase any product or course (18 in most Canadian provinces; 19 in BC, NB, NL, NS, NWT, Nunavut, and Yukon). By making a purchase, you confirm you are of legal age and have the authority to enter into a binding agreement. We reserve the right to refuse service or cancel orders at our discretion.

License to use our content

When you buy a course, micro-course, quiz, PDF, card deck, planner, or other digital product from us, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use that content for your own personal, non-commercial purposes. This means:

  • You may use the content for yourself
  • You may not share, resell, distribute, sublicense, or post the content publicly
  • You may not copy substantial portions for use in your own products or services
  • You may not use our content to train AI/ML models or systems
  • You may not remove copyright notices, attributions, or branding

All content remains the intellectual property of DirectiveHR. Violation of this license terminates your access without refund.

Account responsibilities

If you create an account or are issued login credentials for course delivery, you are responsible for keeping those credentials confidential. Don't share login access. We may terminate accounts that share access or violate these Terms.

Acceptable use

You agree not to use the Site or our products to:

  • Violate any applicable law or regulation
  • Infringe any third party's rights
  • Harass, abuse, or harm any person, including our team
  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorized access to our systems
  • Interfere with the Site's normal operation, including via automated scraping, bots, or denial-of-service attempts

Educational content disclaimer

Important: Our products are educational and reflective in nature. They are not a substitute for professional therapy, medical care, financial advice, or legal counsel. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

Third-party links

Our Site and products may include links to third-party websites or resources. We don't control those sites and aren't responsible for their content, policies, or practices. Visiting them is at your own risk.

Disclaimer of warranties

The Site and all products are provided "as is" and "as available," without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, DirectiveHR, MindsetLab, and our affiliates, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of the Site or our products. Our total liability for any claim relating to a product is limited to the amount you paid for that product.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Site, your violation of these Terms, or your violation of any third party's rights.

Governing law and jurisdiction

These Terms are governed by the laws of the Province of [PROVINCE TO BE INSERTED] and the federal laws of Canada applicable in that province, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved exclusively in the courts of [CITY/PROVINCE TO BE INSERTED], and you consent to that jurisdiction.

Consumer protection rights are not waived

Nothing in these Terms removes or limits any rights you have under provincial or federal consumer protection legislation, including the Consumer Protection Act of your province. If a clause in these Terms conflicts with mandatory consumer protection law, that law applies and the conflicting clause is severed without affecting the rest.

Quebec residents

If you reside in Quebec, the Quebec Consumer Protection Act may grant you additional rights. We make these Terms and our other legal documents available in French on request and will communicate with Quebec consumers in French where required.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date will reflect the change. Continued use of the Site after changes means you accept the updated Terms.

Refund Policy

Most of what we sell is delivered instantly. The moment you click buy, the PDF, audio, or course access lands in your inbox or your dashboard. Because of this, our refund policy is built around clear expectations before you purchase, not regret after. Read this carefully so there are no surprises. Your statutory rights under Canadian consumer protection law are not affected by this policy.

The honest version

We're a small Canadian business. Every refund processed costs us in fees, time, and inventory of our work. So we keep refunds limited and clear — but we will never let a customer feel trapped. If you have a real problem with a purchase, email us. We read every message.

Instant-delivery products — final sale

The following products are final sale, no refunds, because they are delivered the moment you complete checkout and cannot be "returned":

  • All PDFs and downloadable files (including the Idea-to-Action Roadmap, Mom Reality Check, What's Actually Blocking Me, and any future PDF)
  • Card decks and template packs (NT1 5-Minute Mindset Fix Cards, NT5 Founder's Voice Pack, and similar)
  • Printables and planners (NT3 Weekly CEO Check-In Planner, NT4 Daily Mindset Journal, and similar)
  • Audio resets and email-delivered products (S0 3-Day Mom Mindset Reset and similar)
  • Quizzes and assessments (NT2 What's Actually Blocking Me)
  • Any product priced under $30 CAD

By clicking "buy" on any of these items, you acknowledge that the product is digital, instant-delivery, and final sale. We display this clearly at checkout.

Why final sale? Digital files, once downloaded, can't be returned in any meaningful sense. We've found that customers who buy these tend to know what they want — and the price points are deliberately low so the risk of a poor fit is small. Read the product page carefully before purchasing, and if you're unsure, take the related free quiz first.

3-day refund window — courses and bundles

For our higher-investment products, we offer a 3-day refund window from the date of purchase. This applies to:

  • Full courses and micro-courses priced $30 CAD or more (e.g., The "I Feel Behind" Reset, Quieting the Inner Critic, Starting Over courses, Business courses)
  • Bundles of two or more courses

To be eligible, all of the following must be true:

  • You request the refund within 3 calendar days of purchase
  • You have viewed less than 30% of the course content (measured by lessons accessed or files downloaded)
  • You provide the order number and email address used at checkout

If approved, refunds are processed within 5–10 business days back to your original payment method. We can't refund to a different card or account than the one you paid with.

How to request a refund

Email refunds@directivehr.com within 3 days of purchase, including:

  • The email address used at checkout
  • The order number from your purchase confirmation
  • The product name
  • One sentence about why it wasn't a fit (optional but appreciated — it helps us improve)

We respond within 3 business days.

Bundle refunds

Bundles are refundable only as a complete unit, not by component. If you've accessed more than 30% of any course within a bundle, the entire bundle becomes non-refundable. We don't refund individual courses out of a bundle.

Subscription cancellations

For monthly or annual subscription products (such as the future Inner Circle membership): you may cancel future renewals at any time from your account dashboard or by emailing us. Cancellation stops the next charge and you keep access through the end of the current billing period. We don't pro-rate refunds for partial billing periods.

Your statutory rights

This refund policy doesn't override your rights under Canadian consumer protection law. If a product is materially different from what was described, fundamentally defective, or not delivered, you may have additional rights under your provincial Consumer Protection Act regardless of this policy. Contact us first — we'd rather solve it directly.

Chargebacks — please talk to us first

Before initiating a chargeback with your credit card company, please email us. Most refund situations are resolved within a few emails. Chargebacks initiated without first attempting resolution may result in your account being permanently banned, any active courses being revoked, and being prevented from future purchases.

Exceptions

We reserve the right to make exceptions to this policy at our discretion in genuine hardship cases. If something significant has happened in your life and a recent purchase no longer makes sense, just tell us — we will work with you.

This disclaimer is provided in compliance with the Competition Act of Canada and applicable consumer protection legislation regarding representations about earnings, business outcomes, and financial results. Please read it carefully before purchasing any course, bundle, or product from MindsetLab.

The short version: Our courses are mindset and education products. They are not get-rich-quick programs. We make no promise that you'll earn any specific income, grow your business, or achieve any specific outcome. Your results depend entirely on you.

No income or business guarantees

Any income figures, revenue numbers, business growth examples, success stories, or testimonials referenced anywhere in our courses, marketing, sales pages, social media, emails, or website are illustrative examples, not guarantees. They reflect what specific individuals achieved under their specific circumstances and are not representative of what you will achieve.

We make no representation or warranty that you will earn any money, grow your audience, build a successful business, attract clients, increase sales, or achieve any other measurable business outcome from any of our products.

Results vary — significantly

This policy explains what cookies and similar tracking technologies we use, why, and how you can control them. It works alongside our Privacy Policy and reflects compliance with PIPEDA, Quebec's Law 25, and Canada's Anti-Spam Legislation (CASL).

What cookies are

Cookies are small text files stored on your device when you visit a website. They allow the site to remember information about your visit — things like your preferences, login state, or how you navigated. We also use similar technologies (web beacons, local storage, pixels) which work in comparable ways.

Categories of cookies we use

Strictly necessary cookies

Required for the Site to function. These cookies enable basic features like page navigation, secure login to your course portal, and the shopping cart at checkout. Without these, the Site cannot work properly. You can't disable these while still using the Site.

Functional cookies

Help us remember your preferences — language, country, font size, whether you've dismissed a banner. They make the experience smoother on return visits.

Analytics cookies

Help us understand which pages are useful, how people move through the Site, and where we can improve. We use Google Analytics for this. The data is aggregated — we see "200 people read the Quieting the Inner Critic page yesterday," not "this specific person did this." You can opt out of Google Analytics tracking by installing the Google Analytics Opt-Out Browser Add-On.

Marketing & advertising cookies

We use the Pinterest Tag and Meta (Facebook) Pixel on our Site to measure the performance of pins and ads, build audiences for retargeting, and understand what content drives buyers. These cookies allow Pinterest and Meta to show you relevant content elsewhere based on your interaction with our Site. You can manage these:

  • Pinterest: Settings → Privacy & data → Personalisation
  • Meta (Facebook/Instagram): Settings → Ads → Ad Preferences
  • Browser-level: Most browsers let you block third-party cookies entirely

How long cookies last

Two types based on duration:

  • Session cookies — deleted when you close your browser
  • Persistent cookies — remain for a set period (typically 30 days to 2 years depending on the cookie's purpose) or until you delete them manually

How to control cookies

You have several options:

  • Cookie banner — when you first visit, you can accept all, reject non-essential, or customise by category
  • Browser settings — Chrome, Safari, Firefox, and Edge all let you block, delete, or restrict cookies. Search "manage cookies in [your browser]" for instructions.
  • Opt-out tools — for advertising cookies specifically, visit Digital Advertising Alliance or Your Online Choices (EU)
  • Do Not Track — we respect Do Not Track signals where technically feasible

If you block cookies entirely, some parts of the Site may not work. Checkout, login to your courses, and shopping cart all rely on essential cookies. Marketing and analytics can be safely blocked without affecting your ability to use the Site.

Third-party cookies

Some cookies on our Site are set by third parties (Google, Pinterest, Meta, our payment processors). Those cookies are governed by the respective third party's privacy and cookie policies, not ours. We've linked to their controls above.

Marketing emails — CASL compliance

Under Canada's Anti-Spam Legislation (CASL), we send marketing emails (newsletters, course launches, founding-buyer offers) only to recipients who have given express or implied consent. Express consent means you've opted in through a form on our Site or at checkout. Implied consent applies to existing customers for up to two years after a purchase.

Every marketing email we send includes:

  • Clear identification of DirectiveHR as the sender
  • A valid Canadian mailing address
  • A working unsubscribe link that takes effect within 10 business days

If you ever believe we've sent you a message you didn't consent to, email privacy@directivehr.com and we'll investigate immediately. CASL violations carry significant penalties, and we take compliance seriously.

Changes to this policy

If we add new cookies or change how we use existing ones, we'll update this policy and re-prompt for consent where required by law.
